Acceptance of Terms

By accessing or using Pixel Dispatch ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

Description of Service

Pixel Dispatch is a multi-tenant SaaS platform that provides project management, client communication, deliverable management, billing, scheduling, and team collaboration tools for service businesses.

Account Registration and Eligibility

To use the Service, you must:

  • Be at least 18 years old or have the legal capacity to enter into contracts
  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account

Messaging and Communications

If you choose to opt in to SMS/text message communications, you may receive text messages from Pixel Dispatch and the service provider (tenant business) you are working with. SMS consent is optional and is not required to use the Service.

Types of Communications

If you opt in to SMS communications, you may receive the following types of messages:

  • Job Status Updates: Real-time updates about your project status, scheduling changes, and job progress from the tenant business
  • Account Notifications: Important updates about your account, security alerts, password changes, and account activity
  • Delivery Notifications: Notifications about project deliverables, file uploads, and service completions
  • Two-Factor Authentication (2FA): Security codes and authentication messages for account verification
  • Service-Related Communications: Review requests (asking for feedback on tenant services) and other service-related messages

Data Privacy

We respect your privacy and are committed to protecting your personal information. We do not sell, rent, or share your personal information with third parties for their marketing purposes. Message Frequency

Message frequency varies based on your account activity and the services you use. Job status updates are sent as your projects progress. Account notifications, delivery notifications, and 2FA messages are sent as needed for account security and service delivery. Service-related communications such as review requests may be sent periodically.

Opt-Out Instructions

You may opt out of marketing communications at any time by:

  • Replying "STOP" to any SMS message (for text message opt-out)
  • Clicking the unsubscribe link in any marketing email
  • Updating your communication preferences in your account settings
  • Contacting us through our contact form

If you opt out of SMS communications, you will not receive any SMS messages from Pixel Dispatch or the tenant business. You can still access all account features and receive communications via email.

Carrier Charges

Standard message and data rates may apply to SMS/text messages depending on your mobile carrier plan. You are responsible for any charges incurred from your mobile carrier for receiving text messages. Pixel Dispatch does not charge you for sending or receiving these messages, but your carrier may apply standard messaging rates.

User Obligations

You agree to:

  • Use the Service only for lawful purposes and in accordance with these Terms
  • Comply with all applicable laws and regulations
  • Respect the rights of others and not infringe on intellectual property rights
  • Not use the Service to transmit harmful, offensive, or illegal content
  • Not attempt to gain unauthorized access to the Service or other accounts
  • Not interfere with or disrupt the Service or servers
  • Not use automated systems to access the Service without permission

Acceptable Use Policy

You may not:

  • Use the Service to violate any laws or regulations
  • Upload, share, or transmit content that is illegal, harmful, threatening, abusive, or offensive
  • Impersonate others or provide false information
  • Collect or harvest information about other users without consent
  • Use the Service to send spam or unsolicited communications
  • Reverse engineer, decompile, or disassemble the Service
  • Resell or redistribute the Service without authorization

Intellectual Property

Platform Rights

The Service, including all software, designs, text, graphics, logos, and other materials, is owned by Pixel Dispatch and is protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of all content you upload to the Service. By uploading content, you grant us a license to use, store, and process your content solely to provide and improve the Service. You represent that you have the right to grant this license and that your content does not violate any third-party rights.

User Content and Data

You are solely responsible for your content and data. We are not liable for any loss or damage resulting from your content. You agree that:

  • You have the right to upload and share your content
  • Your content does not violate any laws or third-party rights
  • You will backup your important data
  • We may remove content that violates these Terms

Multi-Tenant Responsibilities

Pixel Dispatch is a multi-tenant platform. We implement technical and administrative measures to ensure data isolation between tenants. However, you are responsible for:

  • Maintaining the security of your account credentials
  • Controlling access to your tenant workspace
  • Managing user permissions and roles within your tenant
  • Complying with data protection laws applicable to your use of the Service

Service Availability

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from Service unavailability.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
  • WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM

Indemnification

You agree to indemnify and hold harmless Pixel Dispatch, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

Account Termination

Termination by You

You may terminate your account at any time by cancelling your subscription and contacting us to request account deletion.

Termination by Us

We may suspend or terminate your account if you:

  • Violate these Terms or our Acceptable Use Policy
  • Fail to pay subscription fees
  • Engage in fraudulent or illegal activity
  • Abuse or misuse the Service

Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your account and data in accordance with our data retention policies. You remain responsible for all fees incurred before termination.

Dispute Resolution
